Materials and articles intended to come into contact with food

Import from Third Countries


Materials and articles intended to come into contact with food (FCM) from third countries and brought into the territory of the Community shall be subject to official control at national entry points.

The official control on import falls mainly on the following FCM:

  1. Polyamide and melamine plastic kitchenware originating in or coming from the People's Republic of China and the Hong Kong Special Administrative Region of China-Reg (EU) Nº 284/2011, of the Commission of 22 March.
  2. Ceramics and plastic articles referred to in IC 119

In order to import FCM, food business operators or their representatives must notify the competent authority of the Designated Entry Point (DEP) in advance, at least 2 business days before the physical arrival of the consignment. Such prior notification shall be ensured by the TRACES (Trade Control and Expert System) system, by completing part I of the Common Entry Document (CED).                                                       

In the specific case of the FCM referred to in point 1, food business operators or their representatives, in accordance with Article 3 of REG. (EU) No. 284/2011, shall also submit a Declaration (see Annex I)  for each consignment to the competent authority, duly completed, confirming compliance with the requirements for the release of primary aromatic amines and formaldehyde as set out in Part A of Annex V and Section A of Annex II to DIR. 2002/72/EC, respectively. The digitization of this declaration must be attached to the CED.
