Food  of non-Animal Origin [ FNAO ]

Import from third countries (including Great Britain since 1/1/2021)

 

The movement of goods to the EU from a country that is not a member of the EU is referred to as an 'import’. A country that is not a member of the EU is usually referred to as a 'third country'.

Food business operators intending to import food of non-animal origin (FNAO) from third countries to Portugal shall either: 

The following loads are excluded from these procedures:

  • Consignments of spices, condiments, food additives and similar products with a gross weight < or = 3 kg;
  • Consignments of other foods of non-animal origin with a gross weight < or = 30 kg which are:
    • In passengers' personal luggage and are intended for their consumption or personal use;
    • Non-commercial, sent to natural persons who are not intended to be placed on the market;
    • Sent as commercial samples, laboratory samples or exhibition items, which are not intended to be placed on the market;
    • Destined for scientific purposes.

  • Consignments of food supplements:
    • Imported by an individual for his own consumption only, without any commercial intent, whose purchase value does not exceed EUR 200;
    • Imported for commercial prospecting or laboratory purposes. 



1. Create na account: EU-login

The EU Login is the European Commission's authentication service that allows users to access a range of web services, including TRACES-NT.


i. Go to the page https://webgate.ec.europa.eu/cas/login.

ii.
Click the field “create an account”.

iii.
Enter all the requested data (A valid email is required).

iv.
In the received e-mail message click on the link and follow the instructions.

v.
Choose a password for your account. (Minimum of 10 characters with upper + lower case + numbers + special characters)

: Account created and access granted.

2. Registration in TRACES-NT

TRACES-NT (Trade Control and Expert System-New Technology) is a computer application of the European Commission (DG-Sante).


i. Go to the TRACES-NT

ii. Click the field "Log in to TRACES"

iii. Enter the credentials of the EU-login created

iv. Select the "Operator" profile

v. Check whether the Organization/Company already exists in the system

vi. Select the existing organization or create it by entering its details (full names and addresses) + the Portuguese Tax Identification Number or EORI in the 'Identifier' field

vii. Select in the section/activity the options "Responsible for the consignment (RFL)" and/or "Feed and Food of Non Animal Origin"

viii. Click on "Request permission"

Attention: Access to TRACES-NT can only occur after validation by Border Control Posts (DRAP/RA).

ix. If necessary, request authorization for new areas of activity in "Request new role"

3. Prior notification of the arrival of the goods

Who?

Food operators intending to import or their consignments.

When?

With minimum advance notice of:

  • 2 working days in the case of:
    • Food Supplements appearing in the IC 39 Customs Authority.
    • Products originating in or consigned from Japan after Fukushima
  • 1 working day in the case of the remaining Foodstuffs of Non-animal origin (GAONA):
    • Either those appearing in the IC 19 of the Customs Authority.
    • Or those subject to reinforced controls or EU emergency measures.

How to do it?

Fill in  Part I of the Common Health Entry Document (CHED-D) in TRACES-NT 

Attach the following documents:

  • Digitization of the documents that accompany the goods: Invoice, Bill of Lading/ Airway Bill, Packing List
  • Digitization of certificates, analytical reports, declarations and other compulsory documents mentioned in specific regulations.
  • Completed Form, in the case of foodstuffs containing several ingredients and food supplements.
  • Export documents, including export certificates, in the case of reimport of goods.
  • Other requested documents, such as proof of payment to the Competent Authority, DRAP/RA(1) (contacts).

Pay attention to specific requirements and procedures concerning:

NOTES:

- Operators must complete a distinctive CHED-D for each consignment subject to increased controls or emergency measures.

- In the transfer processes it is necessary to fill 2 CHED-D

4. Presenting Goods for Official Control

The imported goods must be presented for checking at the Border Control Posts (BCP). There they are subject to a 100% documentary check (with presentation of the original documents) and variable percentages of identity and physical checks, including taking samples for laboratory analysis. These checks are carried out by official DRAP/RA inspectors.

In addition to this procedure, specific requirements may need to be met in the context of the procedure:

5. Cost of the controls

The costs of the controls, including the laboratory ones, are supported by the operator (Article 79 and 80 Reg. (EU) 2017/625).

Payments are made to DRAP/RA (
contacts and prices) and to laboratories.




BORDER CONTROL POSTS

According to Reg. (EU) 2017/625 Border Control Posts (BCP) are the former Designated Entry Points (DEP) and Designated Import Points (DIP).

All FNAO must be checked at a border control post. FNAO subject to increased controls or emergency measures may only enter and be checked at BCP.

Only in exceptional situations may official identity and physical controls be carried out at Control Points (CP).
